These terms and conditions govern the professional relationship and services provided by Malik AccounTax Ltd to its clients.
Engagement Letters
While these terms apply to our website and general services, all professional engagements are subject to a specific Engagement Letter which takes precedence over these general terms for specific accounting and tax services.
1. Services and Professional Standards
Malik AccounTax Ltd provides professional accounting, taxation, and business advisory services. We observe the ethical and professional guidelines of our professional bodies and maintain professional indemnity insurance as required by UK regulations.
2. Client Responsibilities
You are responsible for the accuracy and completeness of the information provided to us. We are not liable for any losses or penalties incurred due to inaccurate, incomplete, or delayed information provided by you or your agents.
3. Anti-Money Laundering (AML) Compliance
In accordance with the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations, we are required to verify the identity of our clients and their beneficial owners. We reserve the right to refuse service or terminate engagement if identity verification requirements are not met.
4. Fees and Payment Terms
Fees are quoted exclusive of VAT unless stated otherwise. Payment is due within 30 days of the invoice date.
We reserve the right to charge interest on late payments at a rate of 8% above the Bank of England base rate, plus a compensation fee for debt recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998.
5. Limitation of Liability
Our aggregate liability for any claim, whether in contract, tort, or otherwise, for any loss or damage arising out of our engagement is limited to the amount specified in your individual Engagement Letter or our professional indemnity insurance limit, whichever is lower. We do not exclude liability for death or personal injury caused by our negligence or for fraud.
6. Data Protection
All personal data is processed in accordance with our Privacy Policy and the UK General Data Protection Regulation (UK GDPR). 7. Termination
Either party may terminate the professional engagement by giving 30 days' written notice. We reserve the right to cease work immediately if fees remain unpaid or if we identify a conflict of interest or legal restriction.
8. Governing Law
These terms and any professional services provided are governed by the laws of the UK. Any disputes shall be subject to the exclusive jurisdiction of the UK courts.
